This Privacy Policy explains how GET SWOLE LLC, a New Mexico limited liability company (“SWOLE”, “we”, “us”, or “our”), collects, uses, shares, and protects information in connection with the SWOLE mobile application, website at getswole.now, and related services (collectively, the “Service”). By using the Service, you agree to this Policy.

1. Who this applies to & age requirement

The Service is intended only for individuals who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not use the Service or provide us any information. If we learn we have collected information from a person under 18, we will delete it. You may not upload images of, or information about, any person under 18.

2. Information we collect

Information you provide directly:

  • Account details: email address and authentication credentials (handled by our login provider).
  • Profile and fitness information: age, date of birth, gender, height, weight, training experience, goals, equipment, injuries, and preferences.
  • Workout data: programs, exercises, logged sets, reps, weights, effort ratings, and related notes.
  • Images you choose to upload, such as progress photos or photos of your equipment/meals.
  • Gym and training locations you save.
  • Messages and chat history with the AI coach.
  • Feedback, support requests, and other communications you send us.

Information collected automatically:

  • Usage and behavioral data about how you interact with the app and website (features used, screens viewed, actions taken), which we use to operate and improve the Service.
  • Device and technical data (device type, operating system, app version, identifiers, and log data).
  • Location data, including approximate and, if you grant permission, precise and background location used for geofencing features (for example, to notify you when you arrive at your gym). See Section 5.
  • Cookies and similar technologies, and analytics data, on our website.

Information from third parties:

  • Sign-in providers (such as Apple or Google) when you choose to log in through them.
  • Our payment processor, if and when paid features are offered.
  • Our infrastructure and analytics providers.

3. How we use your information

  • Provide, operate, personalize, and maintain the Service, including generating and adapting your training program and coaching.
  • Deliver location-based features such as geofenced reminders, where you have enabled them.
  • Detect strength progress, surface personal records, and tailor recommendations.
  • Communicate with you about your account, security, and updates.
  • Process payments (through our third-party payment processor) if you purchase a paid feature.
  • Maintain safety and security, prevent abuse, and comply with legal obligations.
  • Analyze usage to understand, debug, and improve the Service.

4. AI coaching and model improvement

The AI coach generates responses and programming by processing your messages and relevant profile and workout data through a third-party AI provider that operates on our behalf to deliver the Service.

We do not use information that identifies you to train or improve machine-learning models. Where we improve our models, features, or coaching logic, we use only de-identified or aggregated data that is not reasonably linkable to you. We do not sell your personal information.

5. Location data

Some features (such as gym geofencing and arrival reminders) rely on location, which may include precise and background location if you grant that permission. Location features are optional. You can enable or disable location access at any time in your device settings, and turning it off will disable location-dependent features but will not otherwise prevent you from using the Service.

6. Health-related & consumer health data

Some information you provide — such as weight, body measurements, training activity, and progress photos — may be considered “consumer health data” under certain state laws (for example, Washington’s My Health My Data Act). We collect and use this information only to provide the Service to you and for the purposes described in this Policy, and only with your consent where required. We do not sell consumer health data, and we will not share it except with service providers who help us operate the Service or as required by law. You may withdraw consent and request deletion of this data at any time by contacting us (see Section 12).

7. How we share information

We share information only as described here. We do not sell your personal information.

  • Service providers / processors who operate the Service on our behalf, including our database, authentication, and storage provider (Supabase), our hosting provider (Vercel), our sign-in providers (Apple, Google), our AI provider, our email provider (Resend), our payment processor (if applicable), and analytics providers. These parties are permitted to use the data only to provide services to us.
  • Legal and safety: to comply with law, enforce our Terms, or protect the rights, safety, and property of users, the public, or GET SWOLE LLC.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
  • With your direction or consent.

8. Data retention

We keep your information for as long as your account is active and as needed to provide the Service, then for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we delete or de-identify your personal information within a commercially reasonable time, except where retention is required by law.

9. Security

We use reasonable technical and organizational measures designed to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

10. Your rights and choices

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of certain processing, and to not be discriminated against for exercising these rights. These include rights under the California Consumer Privacy Act (as amended by the CPRA), the EU/UK General Data Protection Regulation, and similar laws.

  • You can view and update much of your profile data in the app, and delete your account at any time.
  • You can control location and notification permissions in your device settings.
  • To make any other request, contact us at privacy@getswole.now. We will verify your request as required by law.

For EU/UK users: our legal bases for processing are performance of our contract with you, your consent (which you may withdraw), our legitimate interests in operating and improving the Service, and compliance with legal obligations. You may also lodge a complaint with your local data protection authority.

11. Children

The Service is not directed to and may not be used by anyone under 18. We do not knowingly collect data from children. See Section 1.

13. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Policy.
